IMPORTANT NOTICE: BY SIGNING THIS DOCUMENT, YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS ON BEHALF OF YOUR CHILD, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.

Please list any medical conditions, allergies to art materials, food, physical limitations, or special needs that workshop instructors should be aware of.

1. Assumption of Risk 


I understand and acknowledge that participation in art workshops hosted by Kessel LLC involves inherent risks and hazards that may result in personal injury to my child, property damage, or other losses. These risks include but are not limited to: 


Use of age-appropriate sharp tools, cutting instruments, needles, and pointed objects under supervision 

Exposure to paints, solvents, adhesives, and other art materials that may cause allergic reactions or skin irritation 

Use of supervised hot tools such as glue guns or heat guns (age-dependent)

Physical activities including standing, reaching, lifting, and manipulating 

materials

Risks associated with the workshop venue, including slip and fall hazards 

Injuries caused by other child participants or their actions 

Lack of constant one-on-one supervision in group settings 

Pre-existing medical conditions that may be aggravated by workshop 

activities

Risks associated with my child's maturity level and ability to follow instructions 


I voluntarily assume full responsibility for any and all risks of personal injury, property damage, or other losses that may arise from my child's participation, WHETHER CAUSED BY THE NEGLIGENCE OF KESSEL LLC, ITS INSTRUCTORS, OR OTHER PARTICIPANTS, OR OTHERWISE. 

2. Complete Release and Waiver of Liability 


In consideration of my child being permitted to participate in this workshop, I, as parent/legal guardian, for myself and on behalf of my child, heirs, executors, administrators, successors, and assigns, hereby: 

WAIVE, RELEASE, AND DISCHARGE Kessel LLC, its owner(s), employees, instructors, assistants, independent contractors, venue owners, venue operators, and all affiliated parties (collectively "Released Parties") from any and all claims, demands, causes of action, damages, losses, costs, and expenses of any kind whatsoever, including but not limited to: 


Personal injury, disability, or death to my child 

Property damage or loss 

Economic losses 

Emotional distress to my child or family

Any other damages or losses of any kind 


This release applies to all claims ARISING OUT OF OR RELATING TO my child's participation in the workshop, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, including but not limited to: 


Injuries caused by tools, equipment, or materials 

Allergic reactions to art supplies

Injuries caused by other participants 

Accidents related to the workshop venue

Failure to provide adequate supervision or instruction appropriate for 

children 

Failure to maintain equipment in safe condition 

My child's failure to follow instructions or safety guidelines 


3. Indemnification 


I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, demands, causes of action, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: 


My child's participation in the workshop 

My child's actions or conduct during the workshop 

Any injury or damage my child may cause to other participants or third 

parties

Any violation of this waiver by me or my child 

My child's failure to follow safety instructions 


4. Parental Responsibilities and Child Conduct 


I acknowledge and agree that: 

As Parent/Guardian, I am responsible for: 


Ensuring my child is physically and emotionally prepared for workshop 

activities

Providing accurate medical and allergy information 

Ensuring my child understands basic safety rules before the workshop 

Picking up my child promptly at the designated time

Any damage my child causes to venue property or equipment 


My child will be expected to: 


Follow all safety instructions and guidelines provided by instructors 

Use tools and materials only as instructed and for their intended purpose 

Raise their hand and ask for help when needed 

Behave respectfully toward instructors and other participants 

Report any injuries or unsafe conditions immediately 


I understand that: 

Kessel LLC reserves the right to remove disruptive or unsafe participants without refund Constant one-on-one supervision cannot be guaranteed in group settings Children will be supervised according to their age and maturity level. Some activities may be modified based on individual child capabilities 


5. Age-Appropriate Activities and Supervision 


I understand that: 


Workshop activities will be adapted to my child's age group 

Tools and materials will be age-appropriate and introduced with proper instruction

Adult supervision will be provided, but may not be constant individual supervision

My child's safety depends partly on their ability to follow instructions 

Some activities may require closer supervision than others 


6. Venue Liability Separation 


I understand that workshops may be conducted at various locations not owned or controlled by Kessel LLC. I acknowledge that: 


The venue owner/operator is not responsible for workshop instruction or 

supervision Kessel LLC is not responsible for venue-related hazards or conditions  I release both Kessel LLC and the venue owner/operator from liability for injuries occurring at the workshop location


7. Equipment and Property Damage 


I acknowledge that I am financially responsible for: 

Any damage my child causes to workshop materials, tools, or equipment 

Replacement costs for damaged or lost items 

Ensuring my child uses all materials and equipment as instructed 


8. Photography and Media Release 


I grant permission to Kessel LLC to photograph, video record, or otherwise document my child's participation in the workshop for promotional purposes, including but not limited to social media, websites, marketing materials, and print publications. I waive any right to inspect or approve the use of my child's image. 

9. Parental Consent and Legal Authority 


I certify that: 


I am the parent or legal guardian of the above-named child 

I have the legal authority to sign this waiver on behalf of my child 

I have discussed workshop expectations and safety with my child 

I consent to my child's participation in all workshop activities 

I understand that I am giving up substantial legal rights on behalf of my child 


10. Jurisdiction and Governing Law 


This waiver shall be governed by the laws of the State of California. Any legal action arising from this waiver or my child's participation in the workshop must be filed in the appropriate courts of Santa Clara County, California. 


11. Medical Authorization 


I authorize Kessel LLC and its representatives to obtain emergency medical treatment for my child in the event of illness or injury during the workshop, including transport to a hospital or medical facility if necessary. I understand that I am responsible for all resulting medical expenses. I

acknowledge that Kessel LLC staff will not administer any medications, and if medication is needed, it must be administered by the parent or an authorized guardian. 

12. Acknowledgment of Understanding 


I have read this waiver carefully and understand its contents. I am signing voluntarily and with full knowledge that this waiver may affect my legal rights and my child's legal rights. I understand that I am giving up substantial legal rights by signing this document on behalf of my child. 


I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS WAIVER AND VOLUNTARILY SIGN IT WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.

This waiver is intended to be as broad and inclusive as permitted by California law. If any provision is found to be unenforceable, the remainder shall continue in full force and effect.
